4. Your Responsibilities
When using this Website and engaging our Services, you agree to the following:
4.1 Accuracy of Information
You will provide accurate, current, and complete information when submitting enquiry forms or communicating with us. Providing false or misleading information may affect the quality of advice you receive and may bring the engagement to an end.
4.2 Acceptable Use
You agree not to use this Website for any purpose that is unlawful, harmful, or contrary to these Terms. In particular, you will not:
- Attempt to access any part of the Website or its systems without authorisation;
- Transmit any material that contains viruses, malicious code, or harmful data;
- Use the Website to impersonate any person or entity;
- Engage in any conduct designed to disrupt or interfere with the Website's operation;
- Reproduce, distribute, or commercially exploit any Content without our prior written consent; or
- Use the Website to facilitate any fraudulent activity or misrepresentation to a third party.
4.3 Cooperation During Engagement
Where a formal engagement is in place, you agree to respond to reasonable requests for information in a timely manner, disclose relevant documents and records upon request, and inform us promptly of any material change in your circumstances that may affect the matter.
5. Intellectual Property
All Content on this Website — including text, layout, graphic elements, and written materials — is the intellectual property of Sentosa Law or its licensors and is protected under Malaysian copyright law.
We grant you a limited, non-exclusive, non-transferable licence to access and read the Website for your personal, non-commercial use. This licence does not extend to:
- Downloading or reproducing substantial portions of the Website's content;
- Modifying or creating derivative works from any material on the Website;
- Using our name, logo, or branding in any way without prior written consent; or
- Reselling or commercially distributing any Content.
Written summaries and documents prepared for you in the course of a formal engagement remain the property of Sentosa Law until fees are settled in full. Upon settlement, you receive a non-exclusive licence to use those documents for the purposes for which they were prepared.
6. Payment Terms
All fees are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise specified in your engagement letter.
6.1 Fee Schedule
Fees for each service are as published on the Website at the time of engagement. Where the scope of a matter requires work beyond the standard service, we will communicate this to you clearly before proceeding.
6.2 Payment Method
We accept payment by bank transfer, online banking (FPX), and cheque made payable to Sentosa Law. Details will be provided in your engagement confirmation. Payment is required prior to or at the time of each session unless a retainer arrangement is agreed in writing.
6.3 Cancellations and Refunds
If you need to cancel or reschedule a session, we ask that you give us at least 48 hours' notice. Sessions cancelled with adequate notice may be rescheduled without charge. Fees paid for sessions cancelled with less than 48 hours' notice are generally non-refundable, though we consider individual circumstances with care. For ongoing programme engagements, fees paid for completed phases are non-refundable. Fees paid in advance for future phases may be refunded on a pro-rated basis where the engagement ends early due to circumstances beyond your control.
7. Engagement Terms
7.1 Commencement of Services
Our legal advisory services commence upon the earlier of receipt of an engagement letter signed by both parties, or the completion of the initial session. Submitting a website enquiry form does not create a solicitor-client relationship.
7.2 Scope of Services
We will carry out the work as described in these Terms and in any engagement letter issued to you. Where circumstances evolve and additional work is required outside the agreed scope, we will seek your instructions before proceeding.
7.3 Confidentiality
All information you share with us in the course of an engagement is treated with strict confidentiality, in accordance with our professional obligations under the Legal Profession Act 1976 and its subsidiary legislation. We do not disclose client information to third parties except where required by law or with your written consent.
7.4 Timelines
We will endeavour to meet any timelines discussed with you during the engagement. Where delays arise due to factors outside our control — including third-party responses, court scheduling, or EPF administrative timelines — we will keep you informed and revise expectations accordingly.
8. Disclaimers
The Content on this Website is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as such. Legal matters are complex and fact-specific; outcomes depend on individual circumstances that cannot be assessed without a proper engagement.
We make reasonable efforts to keep the information on this Website current and accurate, but we do not warrant that all Content is complete, error-free, or up to date. Laws, regulations, and administrative practices relating to pensions in Malaysia may change; we recommend confirming the current position with us directly before acting.
The Website is provided on an "as available" basis. We do not represent that access will be uninterrupted, or that the Website is free from technical errors.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Sentosa Law's total liability to you in connection with these Terms, the Website, or the Services shall not exceed the fees paid by you to us in the three months preceding the event giving rise to the claim.
We shall not be liable for any indirect, consequential, incidental, or special losses, including but not limited to loss of income, loss of pension entitlements attributable to third-party decisions, or commercial losses, even where we were advised of the possibility of such loss.
Nothing in these Terms limits or excludes liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless Sentosa Law, its solicitors, and staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Website, or any inaccurate or incomplete information you provided to us in the course of an engagement.
11. Termination
11.1 Termination by You
You may end an engagement at any time by written notice to us. We will finalise any work in progress, issue a closing summary, and advise on any outstanding matters that require your attention.
11.2 Termination by Us
We may end an engagement or restrict your access to the Website where: you have provided materially false information; fees remain unpaid after reasonable notice; a conflict of interest comes to light; we are required to do so by law; or continuing the engagement would put us in breach of our professional obligations.
11.3 Effect of Termination
On termination, fees for work already completed become due. Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive the termination of these Terms.
12. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these Terms, the Website, or our Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12.1 Informal Resolution
Before commencing any formal proceedings, we encourage you to write to us at [email protected] setting out your concern. Most matters can be resolved through open dialogue, and we will engage with your concern promptly and in good faith.
12.2 Mediation
Where informal resolution is not possible, both parties agree to consider mediation through the Malaysian Mediation Centre before pursuing litigation, unless urgent injunctive relief is needed.
13. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy and any engagement letter, constitute the entire agreement between you and Sentosa Law with respect to the matters they cover, and supersede any prior discussions or correspondence.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver. Our failure to exercise any right under these Terms does not constitute a waiver of that right.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our obligations to any successor entity without your consent, provided the quality of service is maintained.
Notices. Formal notices under these Terms should be sent to our registered office address or to [email protected].
14. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our services, applicable law, or best practice. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify active clients directly.
Your continued use of the Website after any revision constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, please discontinue use of the Website and contact us to discuss your engagement.
